{"id":326,"date":"2020-01-30T10:20:13","date_gmt":"2020-01-30T10:20:13","guid":{"rendered":"http:\/\/www.rnobahar.ir\/en\/?p=326"},"modified":"2020-01-30T10:29:33","modified_gmt":"2020-01-30T10:29:33","slug":"resultant-moral-luck-and-criminal-law","status":"publish","type":"post","link":"https:\/\/www.rnobahar.ir\/en\/resultant-moral-luck-and-criminal-law\/","title":{"rendered":"Resultant Moral Luck and Criminal Law"},"content":{"rendered":"\n<div class=\"wp-block-file\"><a href=\"http:\/\/www.rnobahar.ir\/en\/wp-content\/uploads\/2020\/01\/MORAL-LUCK.docx\">MORAL-LUCK<\/a><a href=\"http:\/\/www.rnobahar.ir\/en\/wp-content\/uploads\/2020\/01\/MORAL-LUCK.docx\" class=\"wp-block-file__button\" download>Download<\/a><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Resultant Moral Luck and Criminal\nLaw<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Abstract: <\/strong>Moral luck, which is a new concept in moral philosophy,\nchallenges our ordinary&nbsp;moral evaluation.&nbsp; According&nbsp; to&nbsp;\nhuman&#8217;s moral&nbsp; intuition, people&nbsp; are&nbsp; only&nbsp;\nevaluated&nbsp; for&nbsp; their&nbsp; controllable&nbsp; behaviors.&nbsp;\nHowever, while people have no control over results of their behaviors, results\nare effective&nbsp;in&nbsp; our&nbsp; moral&nbsp; judgments.&nbsp; This&nbsp;\nissue,&nbsp; in&nbsp; its&nbsp; turn,&nbsp; raises&nbsp; an essential&nbsp;\nquestion&nbsp; in&nbsp; criminal&nbsp; law:&nbsp; are&nbsp; people&nbsp;\nresponsible&nbsp; for&nbsp; their behaviors&nbsp; in&nbsp; cases&nbsp;\nthey&nbsp; have&nbsp; no&nbsp; control&nbsp; over&nbsp; the&nbsp; results&nbsp;\nof&nbsp; their behaviors?&nbsp; While&nbsp;theorists&nbsp;who&nbsp; agree&nbsp;\nwith&nbsp; moral&nbsp; resultant&nbsp; luck&nbsp; are trying to theorize the\nexisting and prominent practices in penal codes, others who oppose this idea\nattempt to neutralize the role of results in criminal&nbsp;\nresponsibility.&nbsp; As&nbsp; a&nbsp; result,&nbsp; they&nbsp; believe&nbsp;\nthat&nbsp; criminal&nbsp; legal systems should impose equal punishment on\noffenders who commit the same conducts regardless of different results as far\nas they simply stem from&nbsp; moral luck. Consequently, if the proponents&#8217;\narguments in favor of&nbsp; moral&nbsp; resultant&nbsp; luck&nbsp; are&nbsp;\npersuasive,&nbsp; the&nbsp; prominent&nbsp; approach&nbsp; in criminal law\nwould be established.
