Resultant Moral Luck and Criminal\nLaw<\/strong><\/p>\n\n\n\n

Abstract: <\/strong>Moral luck, which is a new concept in moral philosophy,\nchallenges our ordinary moral evaluation.  According  to \nhuman’s moral  intuition, people  are  only \nevaluated  for  their  controllable  behaviors. \nHowever, while people have no control over results of their behaviors, results\nare effective in  our  moral  judgments.  This \nissue,  in  its  turn,  raises  an essential \nquestion  in  criminal  law:  are  people \nresponsible  for  their behaviors  in  cases \nthey  have  no  control  over  the  results \nof  their behaviors?  While theorists who  agree \nwith  moral  resultant  luck  are trying to theorize the\nexisting and prominent practices in penal codes, others who oppose this idea\nattempt to neutralize the role of results in criminal \nresponsibility.  As  a  result,  they  believe \nthat  criminal  legal systems should impose equal punishment on\noffenders who commit the same conducts regardless of different results as far\nas they simply stem from  moral luck. Consequently, if the proponents’\narguments in favor of  moral  resultant  luck  are \npersuasive,  the  prominent  approach  in criminal law\nwould be established. On the other hand, if the opponents’ opinions \nagainst  moral  resultant  luck  are  stronger, \nthen  significant changes would happen in penal code and criminal\ntitles. <\/p>\n\n\n\n
